Decree for the Remission of the U.S. Surtax
On April 16, 2025, the Government of Canada adopted a decree allowing for the remission of surtaxes imposed on certain U.S.-origin products under specific circumstances. This decree, titled Order Respecting the Remission of Surtaxes on Certain Products Originating in the United States (SOR/2025-122), is now in effect.
Four sectors are eligible for this remission:
- Health care and public health
- Public safety and national security
- Goods manufacturing and processing
- Food or beverage product packaging
How does this affect you?
If your business has imported U.S. products that were subject to surtaxes upon entry into Canada, and those products are used in one of the designated sectors above, you may be eligible for a 100% remission of the surtaxes paid.
Remission eligibility conditions:
In accordance with decree SOR/2025-122 and Customs Notice 25-19, applications must meet the following three criteria:
1. Eligible import period:
Goods must have been imported into Canada between the effective date of the applicable surtax and October 15, 2025 (inclusive).
2. No other exemption granted:
The goods must not have benefited from any other form of surtax exemption under the Customs Tariff.
3. Application deadline:
The remission request must be submitted within two years of the date of importation of the goods in question.
